By accessing or using the Services, you acknowledge that you have read this Privacy Notice. If you do not agree, please do not use the Services.

Introduction

This Privacy Notice describes how Tax Network USA and TaxApp LLC (together, “Company,” “we,” “us,” or “our”) collect, use, disclose, and otherwise process information in connection with the Company Platform, including: (a) the websites, web applications, mobile applications, portals, and other online properties that link to this Privacy Notice; (b) the software, tools, features, dashboards, messaging functionality, and related documentation (collectively, the “Software”); and (c) the professional, administrative, and support services offered through the Company Platform (the “Services”) (together, the “Company Platform”).

Entity roles. TaxApp LLC owns and operates the Platform and Software, including the client portal and IRS data monitoring functionality, and processes information in connection with operating the Software. Tax Network USA is an authorized firm delivering the Services through the Platform and processes information in connection with providing the Services. References to “Company” in this Privacy Notice mean TaxApp LLC with respect to the Platform and Software, and Tax Network USA with respect to the Services.

This Privacy Notice applies to information processed about individuals who access or use the Company Platform, including (as applicable) prospective customers, customers, authorized users of customer accounts, and individuals who communicate with Company about the Company Platform (collectively, “Users”). This Privacy Notice applies whether you use the Company Platform directly or through an account created by or for you.

This Privacy Notice does not apply to information processed in the following contexts, which are governed by separate notices or policies where applicable: (i) employment-related processing (job applicants, employees, owners, directors, officers, and contractors); (ii) information processed by third parties that you access via links or integrations from the Company Platform (including payment processors, e-signature providers, and third-party websites), which is governed by their privacy practices; and (iii) information processed offline or outside the Company Platform unless expressly stated.

For clarity, where the Company Platform enables or facilitates engagement with credentialed professionals or other third parties in connection with the Services, this Privacy Notice describes Company’s processing of information as part of operating the Company Platform and administering the Services. Any professional services provided by third parties may also be subject to that third party’s own privacy and confidentiality obligations.

Company’s Operations

The Company Platform is operated from the United States. The Company Platform is intended for use by individuals located in the United States, and the Services are offered only where the Company and its service providers are legally permitted to do so. We do not represent that the Company Platform or Services are appropriate or available for use outside the United States. If you access the Company Platform from outside the United States, you do so on your own initiative and are responsible for complying with applicable local laws, and you understand that your information may be processed and stored in the United States and other jurisdictions as described in this Privacy Notice.

The Company Platform provides software-enabled tools and related support services designed to help Users manage and complete certain tax-related and tax-adjacent workflows. Depending on the specific Service Order or enrollment flow, the Services may include, by way of example: onboarding and intake; document collection and organization; communications facilitation; workflow tracking; preparation and submission support for tax-related forms and materials; coordination with credentialed tax professionals (such as enrolled agents or CPAs) where applicable; status updates and customer support; and other administrative and operational services related to tax resolution, settlement, negotiation support, preparation, and filing assistance. The Company does not guarantee any particular outcome, and tax authorities retain discretion over processing times and decisions.

Certain privacy laws may not apply to some information we process in connection with providing tax-related services. For example, to the extent we process “nonpublic personal information” in connection with providing financial products or services, that processing may be subject to the Gramm-Leach-Bliley Act (“GLBA”) and implementing regulations, and certain state privacy laws may exempt or partially exempt information processed under GLBA (or may limit the rights and obligations that otherwise apply). Where an exemption applies, we will handle the information consistent with applicable requirements (including, as applicable, GLBA obligations), and we will apply the rights and disclosures in this Privacy Notice to the extent required by applicable law.

Information We Collect Through the Services

We collect “personal information” (and, where applicable, “sensitive personal information”) in connection with operating the Company Platform and providing the Services. The categories of personal information we collect depend on how you interact with the Company Platform, the Services you request, and the information you choose to provide.

Information You Provide Directly

When you create an account, enroll in Services, complete intake forms, upload documents, communicate with us, or otherwise use the Company Platform, you may provide personal information such as:

  • Identifiers and contact information: name, mailing address, email address, telephone number, account login credentials, and similar identifiers.
  • Service-related and intake information: information you submit to request or receive Services, which may include tax-related information and documentation (e.g., tax notices, correspondence, returns, forms, filing status, dependent/household information, income-related information, amounts owed, payment history, and information about your interactions with tax authorities).
  • Government-issued identifiers and verification information (as permitted by law): Social Security number, taxpayer identification number, driver’s license or other government ID information, date of birth, identity verification responses, and related documentation.
  • Financial and payment information: payment method details and billing information (note: payment card data is typically processed by our payment processors).
  • Communications and support content: messages and content you submit through the Company Platform, email, chat, SMS, phone calls (including call recordings where permitted by law), and customer support interactions.
  • Authorizations, signatures, and related records: electronic signatures, authorizations you provide (e.g., tax authority authorizations), consent records, and audit logs.
  • User content and files: documents, images, files, and other content you upload or provide through the Company Platform.

Information We Collect Automatically

When you access or use the Company Platform, we (and our service providers) may automatically collect information about your device and usage, including:

  • Device and network information: IP address, device identifiers, operating system, browser type, language settings, mobile network information, and similar technical data.
  • Usage and activity data: pages or screens viewed, features used, links clicked, referring/exit pages, access dates and times, session duration, and other activity on the Company Platform.
  • Approximate location information: general location derived from IP address or device settings (as available).
  • Log, security, and fraud-prevention data: authentication events, access logs, risk signals, and other information used to help secure accounts and the Company Platform and to detect and prevent fraud or abuse.
  • Cookies and similar technologies: cookies, pixels, SDKs, session replay (where used), and similar technologies that help us operate the Company Platform, remember preferences, perform analytics, and support advertising/marketing where applicable. See Cookies and Similar Technologies below for more information.

Information We Receive from Others

We may receive personal information from third parties in connection with operating the Company Platform and providing the Services, including:

  • Service providers and vendors: vendors that support the Company Platform and Services (e.g., hosting, communications, customer support tools, identity verification, fraud prevention, analytics, and payment processing).
  • Credentialed professionals and operational partners: where the Services involve credentialed tax professionals or other partners, we may receive information from them relating to your case or requested Services.
  • Tax authorities and public sources: information from government agencies (e.g., account status information) and public records, as permitted by law and as relevant to providing Services or verifying information.
  • Data sources you connect or authorize: if you authorize access to third-party accounts or data sources (e.g., financial institutions or data aggregators), we may receive information from those sources as authorized by you.
  • Referrals and marketing partners (if applicable): information from referral sources or marketing partners, such as contact information and campaign attribution data, subject to applicable law and your choices.

You are responsible for ensuring that any personal information you provide is accurate and up to date, and that you have authority to provide it (including information about another person, where applicable).

De-Identified, Aggregated, and Derived Data

Where permitted by applicable law, Company may create, derive, or obtain de-identified, anonymized, or aggregated information from personal information (for example, information that cannot reasonably be used to infer information about, or otherwise be linked to, a particular individual, household, or device). Company may use such de-identified or aggregated information for lawful business purposes, including to operate, analyze, improve, and secure the Company Platform and Services; develop new features and offerings; perform analytics and benchmarking; conduct research and quality assurance; and for internal reporting. Company will maintain and use de-identified information in de-identified form and will not attempt to re-identify such information except as permitted by law (for example, to test the effectiveness of de-identification measures or to comply with legal obligations).

How We Use Information We Collect

We use personal information to operate the Company Platform, provide the Services you request, and for other purposes consistent with this Privacy Notice. The specific uses depend on the Services you enroll in and how you interact with the Company Platform, but generally include the following:

  1. Provide, Administer, and Improve the Company Platform and Services. We use your personal information to provide the Services to you, including to create and administer accounts, profiles, and subscriptions; provide core functionality, including tracking, analysis, insights, summaries, and other outputs based on the information you provide and the integrations you enable; connect and maintain integrations you choose to use; process transactions and manage billing and subscriptions; provide customer support and respond to requests, questions, and complaints; and send service-related communications (such as confirmations, updates, security alerts, and administrative messages).
  2. Personalize and Improve User Experience. We use personal information to personalize content and features, such as dashboards, recommendations, goals, and settings; remember preferences and settings across sessions and devices; and tailor the Company Platform to your interests and needs, including by using analytics to understand feature usage and improve the user experience.
  3. Develop, Enhance, and Debug the Services. We use information to maintain, troubleshoot, and debug the Software; monitor performance, conduct quality assurance, and improve reliability and functionality; conduct research and development, including improving existing features and developing new products, services, and capabilities; and create de-identified and/or aggregated data for analytics, product improvement, and other lawful purposes.
  4. Analytics and Measurement. We use information to understand how users interact with the Company Platform, including which features are used and how often; measure and improve the effectiveness of our communications, user experience, and product performance; and generate reports and insights about usage patterns and trends.
  5. Communicate With You. We use information to respond to your inquiries and provide support; send notices about your account and the Company Platform (including policy changes); send surveys and request feedback; and where permitted by law and subject to your choices, send marketing communications.
  6. Marketing, Advertising, and Promotional Activities. We may use information to market or promote the Company Platform (for example, by sending newsletters or promotions, where permitted); administer promotions, sweepstakes, or contests (if offered); and support advertising and marketing measurement (for example, attribution and campaign analytics), which may include the use of cookies, pixels, SDKs, and similar technologies on our websites and within our app, subject to your choices and applicable law.
  7. Security, Fraud Prevention, and Protection of Rights. We use information to secure and protect the Company Platform and our systems; detect, prevent, investigate, and respond to fraud, abuse, security incidents, and other harmful activity; enforce our terms and policies; and protect the rights, safety, and property of Company, our users, and others.
  8. Legal, Regulatory, and Compliance Purposes. We use information to comply with applicable laws and regulations; respond to lawful requests and legal process; maintain appropriate records for legal, compliance, and audit purposes; and establish, exercise, or defend legal claims.
  9. Corporate Transactions. We may use information in connection with evaluating or completing a business transaction such as a merger, acquisition, reorganization, financing, or sale of assets, including sharing information with advisors and counterparties subject to appropriate safeguards and as permitted by law.
  10. Consent-Based Processing and Your Choices. In some cases, we process information based on your consent or choices, for example, when you enable an integration and authorize access to data directly or through your device’s permission controls or opt-in to certain features or communications. You can withdraw consent or change permissions at any time through your device settings, within the Software (if available), or through other mechanisms we provide. Withdrawal of consent does not affect the lawfulness of processing before the withdrawal.

How We Disclose Information

We may disclose the information we collect for the purposes described in this Privacy Notice and as permitted by applicable law. The categories of recipients to whom we may disclose information are described below. We do not disclose information to third parties except as described in this section and in any notices we provide at the time of collection.

  1. Disclosures Between TaxApp LLC and Authorized Firms. TaxApp LLC and Tax Network USA may share information with each other as necessary to operate the Company Platform, deliver the Services, administer billing and subscriptions, and comply with legal obligations.
  2. Disclosures to Service Providers and Processors. We may disclose information to vendors, consultants, contractors, and other service providers that perform services on our behalf (collectively, “Service Providers”). Service Providers are authorized to access and use information only as needed to provide services to us and are contractually required to protect the information and to process it consistent with our instructions. Service Providers may include providers of: cloud hosting, storage, and content delivery; application and website analytics; customer support and communications tools; payment processing and subscription management; security, fraud prevention, and identity verification; error monitoring, debugging, and performance measurement; marketing and email delivery platforms; and professional services (including auditing, legal, and consulting services).
  3. Credentialed Professionals and Operational Partners. Depending on the Services you request and the scope of your Service Order, we may disclose personal information to credentialed professionals (such as enrolled agents, CPAs, or other tax professionals) and other operational partners involved in delivering the Services. This may include sharing information and documentation needed to assess your situation, prepare submissions or communications, coordinate workflows, and provide status updates. We may also receive information back from these parties as part of service delivery. Where applicable, these parties may process information under their own professional obligations and privacy practices.
  4. Legal, Compliance, and Safety Disclosures. We may disclose personal information if we believe in good faith that disclosure is necessary to comply with applicable law or legal process; respond to lawful requests from courts, regulators, tax authorities, or law enforcement; protect the safety, security, and rights of Company, our Users, or others; investigate, prevent, or address fraud, security incidents, or misuse of the Company Platform; or enforce our Terms, Service Orders, and other agreements.
  5. Disclosures to Analytics, Advertising, and Measurement Partners. We may disclose certain information to analytics providers and, where permitted by law and subject to your choices, advertising and measurement partners to understand how users interact with the Software; measure the effectiveness of our marketing campaigns; improve and optimize the Company Platform; and deliver and measure advertising (including interest-based advertising, where applicable). These disclosures may be facilitated by cookies, pixels, SDKs, and similar technologies.
  6. Additional Business Disclosures. We may disclose information to our corporate affiliates for purposes consistent with this Privacy Notice, including providing the Services, internal administration, security, and business management. We may also disclose information in connection with a corporate transaction or contemplated corporate transaction, such as a merger, acquisition, reorganization, financing, bankruptcy, receivership, or sale of all or a portion of our business or assets. Information may be disclosed to advisors, auditors, lenders, and prospective or actual counterparties subject to appropriate confidentiality and security measures, and as permitted by law.
  7. Disclosures With Your Consent or Direction. We may disclose information with your direction or consent, including when you choose to share information through the Services or authorize us to disclose information to a third party.

Cookies, Tracking Technologies, and Advertising Choices

We and our Service Providers use cookies, software development kits (“SDKs”), pixels, local storage, log files, device identifiers, and similar technologies (collectively, “Tracking Technologies”) to operate and improve the Services, understand usage, enhance functionality, and, where permitted by law and subject to your choices, support advertising and marketing measurement. You can control Tracking Technologies in several ways, though some controls may limit functionality.

  • Cookie Preference Tools / Consent Banner (Web). Where required by law or where offered, you can manage certain cookie categories (e.g., analytics or advertising) via the cookie consent banner or the “Cookie Preferences” link in the footer of our websites.
  • Browser Controls (Web). Most browsers allow you to block or delete cookies and manage site data. If you disable cookies, parts of the Services may not function properly. Some browsers offer a “Do Not Track” (“DNT”) signal. Because there is not a consistent industry standard for recognizing and implementing DNT, we do not respond to DNT signals.
  • Mobile Device Controls (App). You may be able to limit or disable certain forms of tracking through your mobile device settings, including: resetting or limiting use of the mobile advertising ID (iOS/Android settings); limiting ad tracking / interest-based ads (device privacy settings); and App Tracking Transparency (iOS) prompts, where applicable, which allow you to permit or deny certain tracking across apps and websites owned by other companies.
  • Email Marketing. You can opt out of promotional emails by using the unsubscribe mechanism included in those emails. You will continue to receive non-promotional, service-related communications (e.g., account notices and transactional messages).

Some Tracking Technologies may be placed by third parties (for example, analytics or advertising partners). Those third parties may collect information about your online activities over time and across different websites or online services, subject to their privacy practices. The Software may also include links to third-party websites, apps, or integrations. We are not responsible for third-party privacy practices, and we encourage you to review third-party privacy policies and settings.

Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Notice, including to provide the Company Platform, operate our business, maintain accurate records, comply with applicable laws and professional obligations, and to establish, exercise, or defend legal claims. In determining how long to retain information, we consider factors such as the length of time you have an account with us and use the Services; the purposes for which the information was collected and processed (including to provide core app functionality, maintain integrations you enable, and support analytics and improvement); the sensitivity of the information and the risk of harm from unauthorized use or disclosure; whether we need the information to resolve disputes, enforce our agreements, or protect the safety and integrity of the Company Platform; and applicable legal or regulatory requirements (including recordkeeping obligations).

Security

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, alteration, and disclosure. Our safeguards are designed to be appropriate to the nature of the information and the risks presented by our processing activities, with regard to sensitive financial information. Despite these efforts, no security measure is perfect and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your login credentials and for any activity that occurs under your account. If you believe your account has been compromised, please contact us promptly using the contact information in this Privacy Notice.

Children’s Privacy

Our services are not intended for, nor directed to, children under 18 years of age. We use age-gating measures to help prevent children under 18 years of age from creating an account and therefore do not knowingly collect personal information from anybody under 18 years of age. If you are under 18 years of age, do not use the Services.

Your Privacy Rights and Choices

Depending on where you live and the nature of our relationship with you, you may have certain rights and choices regarding your personal information under applicable U.S. state privacy laws. This section describes those rights and how to exercise them. We will not discriminate against you for exercising your rights.

Privacy Choices You Can Make in the Services

You may be able to control certain information and features through the Services and your device settings, including:

  • Account Information. You can review and update certain account and profile information through your account settings.
  • Device Permissions and Integrations. Where applicable, you can enable, disable, or change permissions for device integrations through your mobile device settings and, where available, through in-app settings. Revoking permissions may limit certain features.
  • Marketing Communications. You may opt out of promotional emails by using the unsubscribe link in those emails. You may still receive service-related messages (e.g., security or billing notices).
  • Cookies/Tracking and Advertising Controls. See the “Cookies, Tracking Technologies, and Advertising Choices” section for controls relating to analytics and advertising technologies.

Your Privacy Rights

Subject to applicable law and certain exceptions, you may have the right to:

  • Access/Know. Request confirmation from us as to whether or not your personal information is being processed by us and, if so, access to such data and/or the more detailed circumstances of the data processing.
  • Correction/Rectification. Request that we correct any inaccurate personal information relating to you. In this context, taking into account the purposes of the processing, you may also have the right to request the completion of incomplete personal information. You may update the information associated with your account at any time by contacting us or logging into your account.
  • Deletion/Erasure. Request that your personal information be deleted. In certain circumstances, it may not be possible for us to accept your request, for example, when the processing is necessary to comply with a legal obligation, or if the processing is necessary for the performance of a contract.
  • Opt-Out of Targeted Advertising. Request that we not use your personal information from third parties, or disclose, disseminate, or transfer your personal information to a third party, for our targeted advertising or marketing purposes (also known as “sharing” for “cross-context behavioral advertising”). You may opt out of this activity by submitting an “Opt Out of Targeted Advertising” request to info@tnusa.com and updating your cookie preferences via the “Cookie Preferences” link in the footer of our websites and opting out of Targeted Advertising Cookies. Additional information on how to opt out of targeted advertising in your browser on a specific device is available at http://optout.aboutads.info and http://optout.networkadvertising.org.
  • Portability. Request that we provide a copy of the personal information concerning you that you have provided to us in a structured, commonly used and machine-readable format, and transfer this data to another controller without hindrance from us, where feasible.
  • Opt-out of Sale of Your Personal Information. Request that we not sell your personal information. We do not sell personal information.
  • Restriction of Processing. Request that we restrict processing of your personal information. In certain circumstances, it may not be possible for us to accept your request, for example, when the processing is necessary to comply with a legal obligation, or if we can demonstrate compelling legitimate grounds otherwise.
  • Consent Withdrawal. Withdraw your consent that you have previously provided for our collection, use or disclosure of your personal information, subject to reasonable notice and any contractual or legal exceptions. Note that this will not affect the lawfulness of our processing of your personal information based on consent before its withdrawal.
  • Automated Individual Decision-Making. Not be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you. Note that this right shall not apply if such a decision is necessary as part of a contract we have with or want to conclude with you, we have your consent, or we are permitted by law to engage in such automated decision making.
  • Limit Use and Disclosure of Certain Sensitive Personal Information. Direct us to limit our use of certain sensitive personal information to that use which is necessary to perform the services or provide the goods reasonably expected by an average consumer. We do not use sensitive personal information beyond what is necessary to perform the Services or Company Platform.
  • Appeal. Appeal our refusal to take action on your request within a reasonable period after you have received notice of the refusal. You may file an appeal by contacting us as described below (“Contact Us”).

How to Submit a Privacy Rights Request

You or your lawfully designated agent may submit a request to exercise your privacy rights by emailing us at info@tnusa.com. In your request, please include: (i) your full name, (ii) the state where you reside, (iii) the nature of your request (e.g., access/know, delete, correct), and (iv) sufficient detail for us to locate the relevant information (for example, the email address used to communicate with us and the approximate timeframe of your interactions).

You may appoint an authorized agent to submit certain requests on your behalf. We will require proof that the agent is authorized to act for you and may also require you to verify your identity directly with us and/or confirm that you provided the agent permission to submit the request.

How We Process Requests

  1. Intake. Upon receipt, we will log your request, determine which law(s) may apply based on your residency and the context of our interactions, and identify any circumstances or issues that may limit or shape our response.
  2. Verification of Identity. To protect your information, we will take reasonable steps to verify your identity before responding to certain requests (such as access/know, deletion, or correction). Verification steps may include: (a) matching information you provide (e.g., name, email address, phone number) to information in our records; (b) requesting additional information only as reasonably necessary to verify you; and/or (c) using a risk-based approach depending on the sensitivity of the information requested. If we cannot verify your identity (or the authority of an agent), we may deny the request or limit the information we provide.
  3. Processing. We respond to verifiable consumer requests within the timeframes required by applicable law. For example, California generally provides 45 days to respond to certain requests, with a permitted extension (typically up to an additional 45 days) when reasonably necessary and with notice. We will notify you before the end of the initial statutory deadline if we need additional time to respond.
  4. Response. We may respond to your verifiable consumer request by providing the requested information or taking the appropriate action (e.g., deletion or correction) and providing you with notice that we have done so. We may deny a request (in whole or part) where permitted by law, including where: (a) we cannot verify identity or agent authority; (b) the request is subject to an exemption or exception (e.g., compliance and recordkeeping obligations, security, fraud prevention, or legal claims); or (c) Company is not subject to the asserted law and elects, in its discretion, not to honor the request. We will explain the basis for our decision to the extent required by applicable law.
  5. Appeal. If your request is denied, and where applicable law provides you such a right, you may appeal by contacting us at info@tnusa.com with the subject line “Privacy Rights Request Appeal.” We will review and respond to appeals as required by applicable law.

Additional Notice For Certain U.S. States

Several U.S. states have passed data privacy laws over the past few years, such as the California Consumer Privacy Act, as amended (“CCPA”). This section describes additional disclosures that we are required to make under these state-specific privacy laws. We will update this section periodically as new laws and requirements are passed.
